GENERAL TERMS AND CONDITIONS OF THE SERVICES OFFERED

This document is valid as a contract stipulated between the person who registers for a proposed activity and the proposing Guide and/or organization.

trekupitaly.com is a “showcase” site where proposals for hiking, multi-day trekking, courses, mountaineering and outdoor activities are published organized and conducted by professionals in the sector qualified according to the rules and laws in force in the Italian State and in the European Community with recognition of the professional title in the Italian State. Multi-day trips and treks where a “tourist package” is provided are organized in collaboration with tour operators in compliance with the rules of the Tourism Code (Legislative Decree 79/2011). The responsibility for the proposals, organization and management lies with the proposing guide or agency. The property of the “trekupitaly.com” site is in no way responsible for the organization or for damages of any nature that may derive from the adhesion and/or participation of the proposals on the site.

  1. Type of proposals:
     Outdoor activities of various levels and difficulties such as: hiking, multi-day trekking, outdoor trips, outdoor courses, mountaineering, cycling, Nordic walking. The activities take place almost entirely in a natural environment where there are and exist by nature unavoidable dangers. The guide has the task and the ability to minimize, but not to exclude, the risk of exposing oneself to such dangers. The participant must be aware of his or her aptitudes, physical and technical abilities that are suitable for the chosen proposal and that in any case these dangers by their nature are unpredictable and unavoidable and do not depend on the conduct of the guide (general and non-exhaustive examples: accidental falls, stones moved by other people, protruding roots, chains and safety equipment stuck on damaged sections of the route,  sudden and unpredictable thunderstorms or heavy rains, etc …).
  2. Participation in organized activities: Activities take place only when a minimum of 2 and a maximum of 5 participants are reached for day trips, while for multi-day outings the size of the group will be specified on each form and in any case for professional ethics not larger than 10 (ten) people (except for exceptional events such as promotional events,  events in collaboration with other guides, structures, institutions, etc…) The size of the group may vary depending on the difficulty of the route, in which case they are specified in the card or by the Guide. The guide remains the task and the right to evaluate and possibly exclude people deemed unsuitable for the chosen proposal. It is the task of the guide to possibly direct the person on the most suitable proposals on the basis of physical preparation, experience and personal skills of each participant. The Guide remains the task, duty and faculty to modify and/or cancel the excursion according to weather conditions, the group and the conditions of the routes. This decision can be made at any time, even on the same day or during the performance of the activity.
  3. Registration times and methods
    REGISTRATIONS: Registrations for “trekupitaly.com” proposals can only be made on the website (it is necessary to register in advance as users on the website itself) by filling out the registration form on each page dedicated to the proposal. Registrations other than this method (telephone, email, message, etc.) are not accepted. These adhesions have the legal value of a contract. The terms and procedures for registration are indicated in each form and may be different from time to time depending on organizational needs as well as on proposals for several days. If they are not indicated in the form, the general terms are as follows: registration for daily activities will be possible up to the previous day and in any case according to the residual availability of places, while for activities of several days the deadline for registration will be indicated on the relevant form.
    CONFIRMATION: Once the registration has been made, the booking system will send an automatic confirmation email. Reservations are recorded according to the chronological order of their arrival. After this registration, the Guide has the right to contact the member to verify his physical and technical abilities with an interview. If these conditions do not exist, the Guide has the right to exclude the person and provide for a refund or change of activity. If the minimum number of participants is not reached, the Guide reserves the right to cancel the activity, or maintain it by providing for an adjustment of the proposed price.
    CONFIRMATION BEFORE THE EXIT: An email will be sent within the day before the exit indicating weather updates, confirmation of the meetings and any variations, changes of program or cancellation (generally for important weather events). The outings are confirmed even in uncertain weather or rain, except in these conditions, they may expose the group to an unacceptable risk and condition.
    OUTING IN CASE OF BAD WEATHER: The Guide the day before the same and after careful evaluation will decide if the conditions exist for the safe and regular performance of the activity. In agreement with the organization, alternative plans or cancellation will be adopted and timely notice will be given to the members.
    PROGRAM CHANGES: In case the weather conditions are not suitable for carrying out the activity / outing in the established place and day. The guide and/or the organization will look for a similar itinerary in another area where the weather is better by proposing it to the group. Reliable weather forecasts are only visible one day after the release, therefore, program changes can take place the day before or the same day.
  4. Terms and conditions for cancellation of registration
     Conditions for cancellation of registration and related penalties for daily activities
    • The cancellation of the registration of daily outings will be possible up to 65 hours from the date of the outing, excluding the day of departure (example: Sunday outing can be canceled by Thursday at 7.00 a.m.).
    • For cancellations of one-day outings within the terms of the contract indicated above, the amount paid net of bank and administrative charges (3%) will be refunded. Or you can opt for a voucher that can be used within 12 months without any increase in bank charges.
    • For cancellations beyond the maximum terms of the contract indicated above, an amount equal to 50% will be retained, while for the remaining part a voucher will be issued that can be used within 3 (three) months for subsequent registration. After three months, the voucher cannot be claimed and used.

Conditions of cancellation of registration and related penalties for change of program (only for daily activities)
In the event that, following a change of program of a day excursion (for reasons beyond the control of the organization), the alternative destination is not accepted, the fee will be refunded by means of a voucher that can be used within 6 months from the date of issue.
Conditions for cancellation of registration and related penalties for multi-day activities (trekking, travel, courses)
The cancellation of outings, trekking, multi-day trips are different in each proposal and will in any case be indicated in the registration form (clearly displayed before registration). In general, there is a maximum time for the partial refund of the deposit, a maximum time for the penalty of the deposit only. After the indicated deadlines, no refunds will be given, unless you take out travel cancellation insurance with the tour operator. If, on the other hand, the trek is from refuge to refuge or the wording “guide rate + common fund” is specified in the price indications, the only possible refund will be that of the guide rate in the form of a voucher for subsequent use (within 6 months of issue), while any deposit or balance of the refuges or other service cannot be refunded after the terms defined in each proposal.
Terms and conditions of cancellation by the organization, guide, tour operator.
The organization reserves the right to cancel an event if there are dangers for the group, extraordinary weather events, epidemics, serious driving injuries and other cases not dependent on the organization and the guide and which, on the contrary, may compromise the safety of the group and exposure to unacceptable risks. Cancellations for serious cases and independent of the organization can also take place on the day of departure. For cancellations occurring as a result of: strikes, riots, socio-political events, floods, extreme weather events, landslides, collapses, unusable routes and all cases that do not depend on the organization are not fully refundable, except for the fees of the guides and/or the tour operator minus the expenses incurred (commissions, taxes and out-of-pocket expenses already incurred). Any advances and/or balances to facilities, means of transport, insurance and other expenses cannot be reimbursed unless the suppliers themselves make refunds as a result of such events. In such cases, the necessary documentation will be produced to demonstrate what is non-refundable.
Refund policy for cancellation of registration within the deadline – only for day trips.
If the cancellation is made within the terms indicated above (65 hours before the day of the excursion excluded). You can opt for a refund by voucher equal to the amount paid that can be used within 1 (one) year from the date of issue, or for a refund by bank transfer or other electronic system net of accounting, tax and bank commission management fees equal to 5% of the amount.
Refund policy for cancellation by the organization.
The refundable travel fee will be communicated by email with all the documentation attached to justify what is non-refundable. This amount can be reimbursed by bank transfer net of accounting and tax management fees and bank commissions equal to 8% of the amount. Or a voucher can be issued that can be used within 6 (six) months without any increase in accounting and tax management costs and bank commissions.
Prices.
Each proposed activity is associated with a price that generally includes the guide rate and organization costs. These prices may be subject to change due to unforeseen organizational needs. In this case, the necessary documentation will be produced to justify it. The guide rate has a variable cost depending on the proposal, the type of itinerary, commitment and hours spent on the service offered by the guide and the organization. A regular electronic invoice will be issued on what is due to the guide and the organization, and a courtesy copy will be sent by email. In each sheet relating to the individual proposal, it is specified what is included in the guide rate and what is excluded. In multi-day treks, the ancillary expense is also specified in the form of a common fund to be advanced to the guide to pay for the refuges and other expenses. These expenses may vary even during the performance of the activities as they are the pure costs required by the facilities or service providers. Extra expenses will be detailed in the price section of each individual activity. Extra expenses and common funds are not fiscally borne by the guide therefore no invoice or receipt will be issued. For trips, multi-day treks and in general tourist packages will be offered through Travel Agency or Tour Operator according to the rules and conditions regulated by the Tourism Code (Legislative Decree 79/2011).

  1. Responsibilities of the participants and the GuideEach participant in the activities exempts the Guide from any responsibility for injuries, accidents or damages that may occur during transfers to the places of departure, both on the outward and return journeys. Each proposed activity is under the protection and responsibility of the Guide. The responsibility of the Guide is to be understood from the actual beginning of the accompanying activity until the end of the route and only if the participant complies with all the indications provided by the Guide (equipment, clothing, etc.). If requested, the participant must adapt, at any time during the outing – and have the minors accompanied by him or her adapt – promptly and diligently, to the conduct indicated by the Guide or his or her Collaborators, if any, under penalty of forfeiture of any liability of the Guide, and any of his or her Collaborators, towards the safety of the participant himself. At its sole discretion, the Guide may, at any time, in order to protect the safety and well-being of the participants (even of a single participant), modify the program even substantially without this being able in any case to give rise to disputes by the participants, for example, in the event of bad weather, in the event of an accident or serious fatigue of one of the participants,  and in any other case of actual or presumed danger. Those who, by their own will, decide to leave the group and the management of the guide during the activity, must promptly notify the Guide himself; Following this, the Guide will verbalize the person’s decision with digital support and with a witness and from that moment he will no longer be considered under the responsibility of the guide and will leave at his own risk. Compliance with every elementary rule of respect for the environment in which the activity is carried out is required. The Guide reserves the right not to accept those who do not have adequate equipment, in order to guarantee the safety and success of the excursion to the participants.
  2. Obligations of the participantsAnyone who intends to participate in the proposed activities will decide on the basis of their physical and technical preparation, after evaluating the foreseeable difficulties on the basis of the program and other available information, about the opportunity to join and book. The proposed activities take place in a natural environment where there are risks related to normal attendance of the same and where awareness and attention is required to avoid any risk factors (exposed stretches, wild animals, natural obstacles, etc.). Participants in the activities formally undertake to scrupulously observe this document. Each participant is held liable for all damages that the Guide or the organization may suffer due to non-compliance with these rules. Participants have the prior obligation to communicate any non-optimal health conditions and potentially dangerous pathologies in the practice of the proposed “trekupitaly.com” activities. The participant must also preventively and objectively assess the suitability of his or her health conditions with respect to the activity in which he intends to participate: any liability to the Guide or to the organization regarding physical damage resulting from the practice of the proposed activities by unsuitable participants is strictly excluded. Participants are obliged to observe disciplined and correct behavior towards the Guide and other participants. They must also view the characteristics of the excursion (difficulty, length, elevation gain, travel times, etc.) when booking, possibly discussing and asking the Guide for clarification. At the time of booking, the participant undertakes to observe the program of the chosen activity and these Regulations. In addition, the participant is required to:
    • Register only if you are really convinced that you are participating and if you agree with and accept these regulations.
    • If you intend to bring your dog, you must agree it in advance with the Guide. Large dogs and other species of animals are not allowed.
    • Reach the meeting place by your own means or by shared travel if available. For each activity, the place and time of the meeting is indicated. Anyone who, for any reason, should delay or give up showing up, is required to promptly notify the Guide by phone (no messages, text messages, whatsapp). Participants are invited to show up at the meeting points at the established times, delays of more than 15 minutes or that compromise any connections with public transport, may result in exclusion from the trip and the payment of all established fees. The journey from the meeting place to the starting point of the excursion is the responsibility of the participants and under their responsibility.
    • Have clothing and footwear suitable for carrying out excursions and in particular it is required to have high-necked hiking boots with a sturdy and sculpted sole. Tennis shoes, sneakers, boots, combat boots or footwear that are not properly designed for hiking and trekking are not allowed.
    • Follow the directions of the guide diligently
    • Do not exceed the guide for any reason unless expressly indicated and in any case he cannot move more than 10 meters away. Those who overtake the guide are automatically out of their responsibility and cannot make complaints if they get lost or do not find the route.
    • You need to have sufficient ability and pace to follow the pace of the group. The speed and average pace is written on each card. It is therefore required to have the appropriate pace for the proposal.
    • Don’t go off the trails
    • Do not take personal initiatives of any kind. Any requests and/or needs must first be communicated and requested to the guide who will satisfy them as far as possible and within his possibilities.
    • Do not offend, insult, or perform actions that may in any way harm the freedom and opinion of others.
    • Avoid behaviors that can compromise the success of the activity.
    • Do not move away or stop (e.g. need to urinate, etc.) without first informing the guide.
    • Maintain a respectful behavior for nature, not leaving waste, avoiding taking flora and stones
    • Avoid using your mobile phone for calls, messages, social networks as much as possible during the excursion.
    • Avoid going to dangerous places to take photos, selfies or videos or for the simple pleasure of doing so.
    • Do not enter private property.
    • In case of danger, promptly warn the guide without making decisions or taking autonomous actions (e.g. diving into a stream to save someone, running down a slope to save someone, running away in the event of a storm, etc.).
    • Respect the highway code and the code of ethics of the good hiker.
    • On cycling outings, get off the bike in case of pedestrian crossings.
    • Do not exceed the speed limits imposed on cycle paths and in any case 20 km/h.
    • Wear a helmet that complies with the relevant regulations for activities where there may be a risk of falling stones (walls, gullies, scree, etc.) or on cycling tours.
  3. Acceptance of the rules.
    Booking and participation in the proposed activities involve knowledge and unconditional acceptance of all the articles of these regulations and of everything provided for in the program of each individual proposed activity.
  4. Privacy, data and image protection.
    Information pursuant to Article 13 of Legislative Decree 196/2003 (personal data protection) Booking and participation in the activities proposed by Adamo Davide are guaranteed in full compliance with Legislative Decree 196/2003, in paper and digital form. The data collected for registration on the site and registration for activities is necessary to produce what is required by law (invoice) and to activate any insurance coverage. For more specific information, please refer to the documents relating to the “Privacy Policy” and “Cookie Policy” available for free consultation on the “www.trekupitaly.com” website. During the course of the activities, photos will be taken that can then be published on the “www.trekupitaly.com” website or other sites and social networks of public viewing and sharing managed directly by Adamo Davide (for example, Facebook page, etc.) in order to tell, document and illustrate the activity carried out. Those who do not wish to appear on these media must necessarily indicate it during registration by ticking the appropriate box or can make an express request by sending an email to the info@trekupitaly.com address  . In the participation form for individual activities, consent to the processing of data and the use of images will always be requested. All material, texts and images are the intellectual property of Davide Adamo who holds all copyrights. Any form of copying, dissemination, sharing and use without specific written permission is prohibited.
